Terms of Service

These Terms of Service (“Terms”) apply when you use edenvpn.xyz (the “Site”) or hire EDEN Digital Agency (“EDEN”, “we”, “us”) for website or app work. By using the Site or accepting a proposal from us, you agree to these Terms. Our Privacy Policy explains how we handle information.
1. Using the Site
You may browse the Site and contact us for your own business purposes. Please do not misuse it: no attempts to break in, overload it, copy it in bulk with automated tools, or send spam or unlawful content through its forms. We may block traffic that does.
2. Quotes, estimates and the pricing builder
Prices shown on the Site and estimates from the website pricing builder are for guidance only. They are not an offer, an order or a payment. The pricing builder is currently a live test with sample information. Work starts only after we send a written proposal or invoice that lists the scope, price and timeline, and you accept it.
3. Projects and payment
- Your proposal or invoice sets the scope, price, deposit, milestones and number of revision rounds. If it conflicts with these Terms, the proposal wins for that project.
- Work outside the agreed scope is quoted separately before we do it.
- If a payment is late, we may pause work until it is paid. Deposits pay for time already reserved and are not refundable once work has started, unless your proposal says otherwise.
- Timelines depend on you sending content, feedback and approvals when we ask for them.
4. Your content and ownership
- You confirm you have the rights to the text, photos, logos and other material you give us, and you remain responsible for them.
- Once the project is paid in full, you own the final site design and content we made for you. We keep ownership of our own tools, templates, code libraries and know-how, and you receive a license to use them as part of your site.
- We may show the finished work in our portfolio. Tell us if you would rather we change your business name or leave it out.
5. Third-party services
Sites and apps rely on services from other companies, such as hosting, domain registrars, email, payment processors and app stores. Their own terms and prices apply, and we are not responsible for their outages or changes. Domains and accounts we set up for you should be held in your name; we will help you move them if you leave.
6. Hosting, care plans and support
Hosting, maintenance or care plans are billed as described in your plan. You can cancel a monthly plan with 30 days’ notice. We keep reasonable backups and fix problems we caused, but no website can be guaranteed to be online every minute.
7. No guarantees
We build carefully and test before launch, but the Site and our work are provided “as is”. We do not guarantee particular search rankings, traffic, sales or app store approval, because those depend on others.
8. Limit of liability
To the extent the law allows, EDEN is not liable for indirect or consequential losses such as lost profits or data, and our total liability for any claim about a project is limited to the amount you paid us for that project in the three months before the claim.
9. Ending a project
Either side may end a project in writing. You pay for work completed up to that date, and we hand over the finished parts that are paid for.
10. Governing law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules.
11. Changes to these Terms
We may update these Terms. The date at the top shows the latest version. Changes do not affect a project already under a signed proposal unless you agree.
